These Terms of Service (the “Terms”) govern your access to and use of the website operated by Black Bubble, LLC (“Black Bubble,” “we,” “us,” or “our”). By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.

1. Acceptance of these Terms

By accessing or using the site, you confirm that you can form a binding contract and that you accept these Terms and our Privacy Policy, which is incorporated here by reference. We may update these Terms from time to time as described in Section 12.

2. The site and our services

Black Bubble provides go-to-market consulting and advisory services, along with related information and materials made available through this site. The site itself is intended to describe our work and let you get in touch with us.

3. Use of the site

You agree to use the site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

• Use the site in any way that violates applicable law or these Terms;
• Interfere with, disrupt, or attempt to gain unauthorized access to the site, our systems, or other users’ use of the site;
• Introduce malware or other harmful code, or use automated means to access or scrape the site without our permission;
• Misrepresent your identity or affiliation, or submit information that is false or misleading; or
• Use the site or its contents in any manner that could damage, disable, or impair it, or that infringes the rights of others.

We may, at our discretion and without notice, limit, suspend, or terminate your access to the site.

4. Intellectual property

The site and its contents — including text, graphics, logos, design, and the frameworks, methodologies, and materials we make available — are owned by or licensed to Black Bubble and are protected by intellectual property and other laws. The Black Bubble name, logo, and our proprietary frameworks are our property. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the site for your own informational use. No other rights are granted, and any use not expressly permitted is reserved to us.

If you send us comments, suggestions, ideas, or other feedback about the site or our services, you agree that we may use it without restriction or obligation to you. You are responsible for the information you submit and represent that you have the right to submit it.

6. No advice or guarantee

To the fullest extent permitted by law, our total liability for any claim relating to the site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Black Bubble and its members, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the site, your submissions, or your violation of these Terms or applicable law.

11. Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us and attempt to resolve the matter informally. If we cannot resolve it, you agree that any dispute relating to these Terms or the site will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts.

12. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Changes take effect when posted, and your continued use of the site means you accept the revised Terms.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and any separate written agreement covering an engagement, make up the entire agreement between you and Black Bubble regarding the site. You may not assign these Terms without our consent; we may assign them freely.
